Information about the processing of personal data, your rights as a data subject, the use of cookies and data processing within the UM Wear online store.

Legal basis

The processing of personal data is carried out mainly under Regulation EU 2016/679, the General Data Protection Regulation, and applicable national data protection laws.

Purpose of processing

We process personal data mainly for order processing, invoicing, delivery of goods, compliance with legal obligations, customer communication, marketing and operation of our online store.

Storage period

Order and invoice data are stored for the period required by statutory retention obligations. Marketing data are processed only for as long as consent exists or a legitimate interest applies and no objection has been made.

1. General provisions

1.1 Personal data are processed in accordance with Regulation EU 2016/679, the General Data Protection Regulation, hereinafter referred to as “GDPR”, and with applicable national data protection laws.

1.2 The controller processes personal data only where there is a valid legal basis. This may include the performance of a contract, steps taken before entering into a contract, compliance with legal obligations, consent of the data subject or the legitimate interest of the controller.

1.3 The controller does not disclose the customer’s personal data to third parties without a legal basis. Data may be disclosed in particular to service providers necessary for order processing, such as shipping providers, payment providers, IT service providers, hosting providers, accounting providers or competent public authorities where required by law.

1.4 The controller applies appropriate technical and organisational measures to protect personal data against unauthorised access, loss, misuse, alteration or disclosure. Persons who work with personal data are bound by confidentiality.

Rights of the data subject

1.5 As a data subject, you have in particular the following rights under the GDPR:

  • the right of access to your personal data,
  • the right to rectification of inaccurate or incomplete personal data,
  • the right to erasure of personal data, where the legal conditions are met,
  • the right to restriction of processing,
  • the right to data portability,
  • the right to object to the processing of personal data,
  • the right to withdraw consent at any time with effect for the future,
  • the right to lodge a complaint with a competent data protection supervisory authority.

Where processing is based on consent, you may withdraw that consent at any time. The lawfulness of processing carried out before the withdrawal remains unaffected.

Processed personal data

1.6 Within the online store and customer communication, we may process in particular the following personal data:

  • title or salutation, if provided,
  • first name and surname,
  • billing address,
  • delivery address,
  • phone number,
  • e-mail address,
  • order information,
  • payment information, to the extent necessary for payment processing,
  • communication content that you send to us as part of an enquiry or order.

These personal data are processed in order to correctly accept, process, produce, ship and invoice orders.

As part of order processing, personal data are used in particular for issuing invoices, delivery notes, shipping documents, accounting documents and for communication with the customer.

The provision of certain data is necessary for concluding and performing a contract. Without such data, an order may not be processed or may not be processed completely.

1.7 Our website may use cookies and similar technologies. Cookies are small text files stored on your device and may contain certain information.

Cookies may be technically necessary for the website to function properly, for example for shopping cart functions, language settings, security or website display.

1.10 Processing for e-mail marketing is generally based on your consent. In certain cases, promotional communication with existing customers may also be based on legitimate interest, where permitted by applicable law and where you have not objected.

1.11 You may withdraw your consent to receive marketing e-mails at any time. This can be done, for example, by sending a message to info@umwear.com or through an unsubscribe link in the respective e-mail, if such link is available.

1.12 After withdrawal or unsubscribe, your data will no longer be used for marketing purposes, unless another legal basis for further storage exists.

2. Personal data processing activities

Online store and order processing

Purpose of processing: Sale of goods, acceptance and processing of orders, production or preparation of ordered products, issuing invoices, shipping and customer communication.

Processed data: title or salutation, first name, surname, billing address, delivery address, e-mail address, phone number, order content, payment and shipping information.

Legal basis: performance of a contract or steps taken before entering into a contract, as well as compliance with legal obligations.

Accounting and statutory retention

Purpose of processing: Compliance with tax, commercial and accounting obligations, archiving of invoices and business records.

Processed data: customer identification and contact data, invoice data, payment data, order data and other tax-relevant information.

Legal basis: compliance with legal obligations.

Customer communication

Purpose of processing: responding to enquiries, communication regarding orders, clarification of technical or organisational matters, handling complaints or other requests.

Processed data: name, e-mail address, phone number, message content, order reference and communication history.

Legal basis: performance of a contract, pre-contractual measures or legitimate interest in proper communication with customers and interested persons.

Marketing and newsletter

Purpose of processing: providing information about products, offers, news, promotions or UM Wear content.

Processed data: name, e-mail address and, where legally permitted, information about previous orders or interests.

Legal basis: consent of the data subject or legitimate interest, where permitted by law.

Customer account and loyalty programme

Purpose of processing: management of a customer account, easier order processing, overview of orders, granting discounts or benefits to registered customers.

Processed data: name, e-mail address, phone number, billing address, delivery address, order history and account-related information.

Legal basis: performance of a contract, consent or legitimate interest, depending on the specific function.

Competitions and promotions

Purpose of processing: organisation of competitions, promotions or similar campaigns, evaluation of participation and contacting winners.

Processed data: name, e-mail address, phone number, address, participation details and any other data necessary for the specific promotion.

Legal basis: consent, performance of a contract within the terms of participation or legitimate interest in conducting the promotion.

Recipients and disclosure of personal data

2.2 Personal data are generally not published and are not disclosed to third parties without a legal basis.

Disclosure may take place where necessary for order processing, compliance with legal obligations or operation of the website.

Recipients of personal data may include in particular:

  • shipping and logistics providers,
  • payment providers and banks,
  • accounting and tax service providers,
  • IT service providers and hosting providers,
  • operators of technical systems of the online store,
  • marketing or newsletter service providers, if used,
  • competent authorities, courts or other public bodies, where required by law.

Where service providers process personal data on our behalf, this is done on the basis of appropriate data processing agreements.

Transfer of personal data to countries outside the European Union or the European Economic Area takes place only where there is an appropriate legal basis, such as an adequacy decision, appropriate safeguards or explicit consent.

After the purpose of processing no longer applies and statutory retention periods have expired, personal data are deleted or restricted, unless another legal basis for storage exists.

Withdrawal of consent and data subject request

2.3 Where the processing of personal data is based on your consent, you may withdraw that consent at any time with effect for the future. Withdrawal may be made by e-mail to info@umwear.com or in writing to UM Crew s. r. o., Petzvalova 3379/67, 010 01 Žilina, Slovakia.

2.4 You may request information at any time as to whether and which personal data we process about you. You may also request rectification of inaccurate data, erasure of personal data, restriction of processing or transfer of your data, provided that the legal requirements are met.

2.5 If you believe that the processing of your personal data violates data protection law, you have the right to lodge a complaint with a competent data protection supervisory authority.

2.6 Data subject requests are generally handled without undue delay. To prevent unauthorised disclosure of personal data, it may be necessary to verify your identity.
